Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the AETHERA Health platform (“Platform”), operated by Eureka Medical, LDA(NIPC 514005793), trading as AETHERA Health (“we”, “us”, “our”). By creating an account or using our services, you agree to be bound by these Terms.
2. Eligibility
- You must be at least 18 years of age.
- You must be a resident of a European Union member state.
- You must provide accurate and complete information during registration and health assessments.
- You must not use the Platform for anyone other than yourself, unless explicitly authorised.
3. Nature of Services
AETHERA Health is a telehealth platform that connects patients with licensed EU physicians for remote consultations, health assessments, and prescription services. Our services include:
- AI-guided health assessments and triage.
- Asynchronous physician consultations and prescription issuance.
- Medication fulfilment and delivery via EU-licensed pharmacy partners.
- AI-powered health monitoring and coaching.
Important: AETHERA Health is not an emergency medical service. If you are experiencing a medical emergency, call 112 (EU emergency number) or your local emergency services immediately.
4. Medical Disclaimer
All medical advice, prescriptions, and treatment plans provided through the Platform are issued by independently licensed EU physicians. AETHERA Health provides the technology platform but does not itself provide medical advice. Treatment decisions are made solely by the prescribing physician based on the information you provide. You are responsible for the accuracy of the health information you submit.
5. AI Health Assistant
Our AI health assistant provides general health information, wellness coaching, and treatment support. It is not a substitute for professional medical advice. The AI assistant does not diagnose conditions, prescribe medications, or make treatment decisions. Always consult your physician for medical concerns. AI-generated content is clearly labelled as such.
6. Subscriptions and Payment
- Subscriptions are billed monthly in Euros (EUR) via Stripe.
- Your subscription renews automatically unless cancelled before the end of the current billing period.
- You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- Medication costs are separate from subscription fees and billed at the time of dispensing.
- Refunds are handled on a case-by-case basis. Contact info@eurekamedical.eu for refund requests.
- We reserve the right to change subscription prices with 30 days' written notice.
7. Prescriptions and Medications
- All medications prescribed through AETHERA Health are approved by the European Medicines Agency (EMA).
- Prescriptions are issued at the sole discretion of the reviewing physician. We cannot guarantee that a prescription will be issued.
- Medications are dispensed by EU-licensed pharmacies and shipped directly to your address.
- You must follow the prescribed dosage and instructions. Report any adverse effects to your physician immediately.
- You must not share, sell, or distribute prescribed medications.
8. Your Responsibilities
- Provide truthful and complete health information.
- Keep your account credentials secure and confidential.
- Notify us immediately of any unauthorised access to your account.
- Use the Platform only for its intended purpose of managing your personal health.
- Do not attempt to reverse-engineer, scrape, or disrupt the Platform.
9. Intellectual Property
All content, designs, trademarks, and technology on the Platform are owned by Eureka Medical, LDA or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent. “AETHERA” and “AETHERA Health” are trademarks of Eureka Medical, LDA.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Eureka Medical, LDA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid us in subscription fees during the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable EU or Portuguese law.
11. Termination
We may suspend or terminate your account if you violate these Terms, provide false health information, or engage in conduct that may harm other users or the Platform. You may delete your account at any time from your settings page. Upon termination, your health records are retained as required by EU healthcare regulations (see our Privacy Policy).
12. Governing Law and Disputes
These Terms are governed by the laws of Portugal and the European Union. Any disputes shall be resolved in the courts of Lisbon, Portugal, without prejudice to your rights under EU consumer protection law to bring proceedings in the courts of your member state of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email and in-app notification at least 30 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
